Summit Group Digital Pty Ltd operates under the brand names Summit and Summit Markets, including via our website summitmarkets.net. This policy applies to the Summit Members membership. Summit provides research and education only. It is not personal financial advice, and Summit does not hold an Australian Financial Services Licence.
When Refunds Are and Are Not Available
Because our products are digital and access is granted promptly on purchase, we do not offer discretionary refunds in the situations listed below. This does not affect, and is subject to, your rights under the Australian Consumer Law, including the consumer guarantees that services be provided with due care and skill and be reasonably fit for any purpose we have agreed. If those guarantees are not met you may be entitled to a remedy regardless of anything in this list. We do not offer discretionary refunds for:
- Change of mind or no longer wanting the membership.
- Failure to use the Services during the membership period, including failure to attend live sessions or book one on one sessions made available to you.
- Your own trading or investing decisions and their outcomes. Mere change of mind or disagreement with our educational opinions is not by itself a basis for a discretionary refund, but this does not limit your Australian Consumer Law rights if the Services were not provided with due care and skill.
- Failure to cancel a recurring plan before renewal, including quarterly renewals of Summit Members memberships.
- Third party platform outages or disruptions outside our control, including our payment provider.
- Termination of your access for your own breach of our Terms of Service. If we end your membership for a reason other than your breach, we will refund the unused portion of the quarter on a pro rata basis, as set out in our Terms of Service.
Summit Members
Summit Members memberships are billed quarterly in advance and renew automatically each quarter unless cancelled before the renewal date. To cancel, use your Stripe billing portal or email us at summitgroupdigitalptyltd@gmail.com before your renewal date, in line with the Cancellation section of our Terms of Service. In addition to the general terms above:
- Admission is by application, and your membership fee covers access to the Membership Services for the full quarter, whether or not you attend sessions or use the tools provided.
- No pro rata refunds are provided if you cancel part way through a quarter. Your access continues until the end of the quarter you have paid for.
- If we discontinue the Summit Members membership entirely, or materially reduce the Membership Services during a quarter you have paid for, we will refund the unused portion of that quarter on a pro rata basis or offer an equivalent credit, at your election.
- Membership fees are not contingent on any trading outcome, market result, or level of satisfaction with educational content.
- We do not offer satisfaction based, results based or engagement based refunds or guarantees of any kind. Whether you attend sessions, take part in the community or use the tools provided is up to you, and not using them does not entitle you to a refund.
System Error Exception
Where a technical error on our side prevents you from accessing the Services you purchased and we cannot reasonably remedy it within a reasonable timeframe, generally within 5 business days of being notified, we will provide a refund, credit or service extension that fairly reflects the period and extent of the disruption. We will act reasonably in assessing this, and this is in addition to any remedy you are entitled to under the Australian Consumer Law. This exception does not apply where the disruption is caused by a third party platform or by factors outside our reasonable control.
Australian Consumer Law
Nothing in this policy is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot be excluded by contract. To the extent that such statutory rights apply, including consumer guarantees that services be provided with due care and skill and be fit for purpose, we will comply with our obligations under them.
How to Request a Refund
If you believe you are entitled to a refund under the System Error Exception, the Summit Members provisions above, or applicable consumer law, please contact us at summitgroupdigitalptyltd@gmail.com and include your order email address and transaction receipt, a clear description of the issue experienced, and any relevant screenshots, logs, or evidence of the error. We may request additional information to investigate your claim.
Review Timeframe
We aim to acknowledge refund requests within 2 business days and to complete our review within 7 to 10 business days of receiving all required information.
General Provisions
If any provision of this policy is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. This policy is governed by the laws of New South Wales, Australia.
